Attempt to Expel Sen. Nicole Mitchell Fails in Minnesota Senate

Senate Republicans failed in their attempt to expel DFL Senator Nicole Mitchell of Woodbury during Monday’s legislative session. Mitchell faces a burglary charge for allegedly breaking into her stepmother’s Detroit Lakes home to retrieve items belonging to her late father.
Sen. Michael Kreun (R-Blaine) argued that Mitchell’s request to delay her trial was “making a mockery of the Minnesota Senate” and called for her immediate removal.
Democrats pushed back, with Sen. Nick Frentz (DFL-Mankato) citing Senate rules requiring the ethics subcommittee to wait for a criminal case to be resolved before taking action.
A procedural vote to override the ruling against expulsion ended in a 33-33 tie, well short of the two-thirds majority required to remove a senator.
Mitchell remains in office as her legal proceedings continue.
